Please read these Terms & Conditions carefully before using the Saffly mobile application or website. By accessing or using Saffly, you agree to be bound by these terms. If you do not agree, do not use the App or Website.
1. Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and [COMPANY NAME] ("Saffly", "we", "us", "our"), governing your access to and use of the Saffly mobile application ("App") and the website at saffly.my ("Website") (collectively, the "Service").
By registering an account, accessing the App or Website, or making a donation through the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable Malaysian laws and regulations.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
Saffly is a mobile platform that enables Muslims in Malaysia to:
- Discover mosques, suraus, and Islamic charitable organisations ("Institutions");
- Browse and follow active fundraising campaigns;
- Make charitable donations (sadaqah, zakat, infaq) to Institutions via FPX online banking;
- View their donation history and download digital receipts.
Saffly facilitates donations between donors and Institutions. We do not directly hold, manage, or disburse donated funds. Payments are processed exclusively by our authorised payment service provider, HerePay, and are transferred directly to the receiving Institution's designated bank account.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.
3. User Accounts and Registration
3.1 Eligibility
You must be at least 18 years of age to register and use the Service. By creating an account, you represent and warrant that you meet this requirement.
3.2 Registration
Registration requires a valid Malaysian mobile phone number. You will receive a one-time password (OTP) via SMS to verify your identity. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to:
- Notify us immediately at hello@saffly.my of any unauthorised use of your account;
- Not share your account credentials with any third party;
- Not create more than one account per individual.
3.4 Account Termination
We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or Institutions on the platform.
4. Donations and Payments
4.1 Payment Processing
All donations are processed via FPX (Financial Process Exchange), Malaysia's national online banking transfer scheme, through our payment service provider HerePay. By initiating a donation, you authorise the corresponding debit from your designated bank account.
4.2 Donation Amounts
The minimum donation amount is RM 1.00. All amounts are denominated in Malaysian Ringgit (RM). Saffly does not charge donors any platform fee on top of the donated amount; institutional fees, if any, are disclosed separately.
4.3 Receipts
A digital receipt is automatically generated for every completed donation. Receipts are accessible within the App and can be downloaded at any time. These receipts serve as records of your transaction but do not constitute official tax exemption certificates unless expressly stated.
4.4 Failed Transactions
If a payment fails, no donation is recorded and no amount is deducted. If you believe an amount was deducted without a corresponding donation being recorded, contact us immediately at hello@saffly.my.
4.5 Campaign Goals
Fundraising campaigns may display goal amounts and deadlines. These are targets set by Institutions and are not guaranteed. Saffly does not guarantee that any campaign will reach its stated goal.
5. Refund Policy
Donations made through Saffly are generally non-refundable. By completing a donation, you acknowledge that it is a voluntary charitable contribution intended for the designated Institution or campaign.
Exceptions apply in the following circumstances:
- Technical error: A verified system error resulted in an incorrect charge or a donation being attributed to the wrong Institution or campaign;
- Duplicate charge: A verified duplicate payment occurred due to a processing error (i.e., the same donation was deducted more than once).
To request a refund under these exceptions, you must:
- Contact us at hello@saffly.my within 14 calendar days of the transaction;
- Provide your full name, registered phone number, donation reference number, amount, and a description of the issue.
We reserve the right to investigate all refund requests before approving or declining them. Approved refunds will be processed back to the original payment method within 7–14 business days, subject to bank processing times.
6. Institution Verification
Institutions listed on Saffly undergo a verification process to confirm their existence and identity. Verified Institutions are marked with a verified badge on their profile.
However, verification by Saffly does not constitute:
- An endorsement of the Institution's management, governance, or financial practices;
- An audit of how donated funds are used;
- A guarantee of the Institution's legal status, tax exemption status, or compliance with all applicable laws.
Donors are encouraged to conduct their own due diligence before donating. Saffly is not responsible or liable for the actions, omissions, or financial management of any Institution listed on the platform.
7. Prohibited Uses
You agree not to use the Service to:
- Violate any applicable Malaysian law or regulation, including the Payment Services Act 2019, Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA), or the Personal Data Protection Act 2024;
- Make fraudulent donations or engage in any form of financial fraud;
- Launder money or process proceeds of unlawful activity;
- Impersonate another person or entity;
- Attempt to gain unauthorised access to any part of the Service, other accounts, or our servers;
- Use automated tools, bots, or scripts to access or interact with the Service without our written consent;
- Reverse-engineer, decompile, or disassemble any part of the App;
- Transmit any content that is unlawful, defamatory, or harmful.
Violations may result in immediate account suspension, reporting to relevant Malaysian authorities, and legal action where warranted.
8. Intellectual Property
All content, software, design, graphics, trademarks, logos, and other materials forming part of the Service are owned by or licensed to [COMPANY NAME] and are protected by Malaysian intellectual property law.
Content submitted by Institutions (including institution profiles, campaign descriptions, and images) remains the intellectual property of the respective Institution. By uploading content to our platform, Institutions grant Saffly a non-exclusive, royalty-free licence to display that content within the Service.
You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose;
- Uninterrupted or error-free operation;
- Accuracy or completeness of any information on the platform;
- Availability of FPX payment services (subject to individual bank availability).
We do not warrant that the App will be free from viruses or other harmful components. You are responsible for maintaining appropriate security on your device.
10. Limitation of Liability
To the maximum extent permitted under Malaysian law, including the Consumer Protection Act 1999, [COMPANY NAME]'s total liability to you for any claim arising from or related to the Service shall not exceed the total amount you have paid through the Service in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of donations due to failed transactions caused by third-party payment systems;
- Losses arising from the actions of any Institution on the platform;
- Loss of data, goodwill, or business opportunity;
- Damages arising from your reliance on information provided by Institutions.
Nothing in these Terms limits liability for fraud, death, personal injury, or any other liability that cannot lawfully be excluded or limited under Malaysian law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, the dispute may be referred to mediation under Malaysian mediation procedures. If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our Service, applicable law, or business practices. When we make material changes, we will:
- Update the "Last updated" date at the top of this page;
- Notify you via an in-app notification or email (where an email address is on file) at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion by contacting us.
